2. Use of this site

2.1 The FoodTech Bridge service is comprised of information, content and images, which includes but is not limited to free and subscription-based newsletters, and domestic and international news provided by FTB and third parties.
2.2 Access to certain pages of and information contained on this Website may be restricted to Subscribers.
2.3 Use of this Website is strictly at the sole risk of the User.
2.4 Any and all illegal, unlawful or fraudulent conduct, including Click Fraud, directed towards this Website or any of the services offered through it, is strictly prohibited.
2.5 In order to use the Website effectively, you must as a minimum ensure that you have the hardware and software recommended by FTB for optimal functioning of and compatibility with the Website. You acknowledge that FTB does not deal in or sell any computer hardware, software or any other form of equipment required for the use of the Website, but merely provides you with the minimum suggested computer system requirements and specifications for the proper operation of the Website. The User will at all times be responsible for the purchase and installation of any computer hardware, software or other components or systems that may be required for the use of the Website.

3.1 FTB expressly reserves the right in its sole discretion to effect any amendment or alteration to the content and information, including pricing and rates provided by the automated quotation system set out in this Website.
3.2 Users acknowledge that it is their responsibility to familiarise themselves with any amendment or alteration effected to the Website.

6.3 Subject to Chapter 7 of the ECT Act and to the fullest extent possible under the applicable law, FTB disclaims all responsibility or liability for any indirect damages, economic, consequential loss or loss of profits, resulting from the use of or inability to use (including but not limited to non-receipt of services) this Website in any manner.
6.4 FTB has no control over third party content and features which can be accessed through the use of this Website and does not examine or edit such content and features or act as an agent for third parties accessible through this Website. As such and to the fullest possible extent permissible under law FTB disclaims any liability whatsoever to Users for any loss or damage arising from the use of third party websites, contents, information and features. FTB can further not guarantee that the links to third party websites provided in our Website are free of viruses or technical defects of any description.
6.5 FTB will not be liable to you for any loss or damage, whether direct, indirect, economic or consequential in nature, suffered as a result of use of this Website if you fail to ensure that you have the minimum hardware and software recommended by FTB (as mentioned in clause 5 above) in order to use this Website effectively.

FTB expressly reserves the right, in its sole and absolute discretion, to alter or amend any criteria or information set out in this Website without notice. Accordingly, any information, including content, ingredients and articles, in this Website is not intended to constitute consulting or other advice or services. Before making any decision or taking any action based on the information contained on this Website, which decision or action might affect your personal finances or business, you should consult a qualified professional advisor.

9. Subscriptions

9.1 FTB offers a comprehensive range of information subscription services to individuals, groups and organisations, including e-mail subscriptions to various services. The content provided on the Website is on an ‘as is’ basis and it will always remain the responsibility of the User to ensure that their required preferences are met prior to subscribing to FTB. We do not offer any refunds and it will remain the responsibility of the Subscriber to manage their own subscription account and payments.
9.2 The provision of such service is contingent upon full payment for such services being received by FTB. The Subscriber agrees and undertakes to pay the stated subscription fees in full immediately upon receipt of the relevant invoice from FTB.
9.3 The free 24 (twenty four) hour trial subscription offered by the Website has been made available as a once-off opportunity to allow a User, group or organisation the opportunity to assess the desirability of the services offered. Under no circumstances may a user, group or business abuse the trial in any way, including but not limited to:
9.3.1 a user using a variety of e-mail addresses in order to take advantage of the trial period more than once; and/or
9.3.2 a business using different e-mail addresses owned by that business in order to take advantage of the trial period more than once.
9.4 When making application to become a Subscriber, Users agree that:
9.4.1 they will be irrevocably bound by the terms and conditions applicable to the use of this Website;
9.4.2 they will provide full and accurate information;
9.4.3 it is the User’s responsibility to check and update information pertaining to their User account and payment arrangements
9.4.4 registration is for a single User only and a subscriber’s username and password cannot be shared with any other person; and
9.4.5 a single username and password cannot be used to allow multiple access to other users over a network.
9.4.6 the subscription shall automatically be renewed for the same period without any notice supplied. Should the User wish to cancel or opt out of their membership then it shall remain their sole responsibility to do so. Otherwise FTB will deem it confirmed that the Subscriber has provided the required authorisation to collect the applicable subscription fee and any other fees using the payment method held on file.
9.4.7 they may cancel their subscription at any time and will still have access to the website until the end of the described renewal period. FTB does not offer any credits for partial month subscription.
9.4.8 no refunds will be offered by FTB
9.5 All quotations provided by FTB whether manually created or created by the automated quotation system — are provided subject to the correct information being provided by the User to FTB. If FTB discovers, after the quotation was accepted by the User (and thus an agreement was created), that false information was provided by the User, the agreement for the subscription will be deemed to have been cancelled and FTB shall be entitled to recover all and any monies that would have been due to FTB had the User provided the correct information in the first instance.
9.6 Every effort is made by FTB to provide accurate pricing via the automated quotation system. However, should the automated system provide an incorrect quotation, FTB reserves the right to cancel the quotation and provide the User with a corrected version.
9.7 Subscribers and Users further undertake not to:
9.7.1 impersonate any other person or use a false or unauthorised name so as to create a false identity and/or e-mail address or to misrepresent the origin or identity of any communications;
9.7.2 modify, access or make available any data stored on a computer device which has been accessed through FTB’s network;
9.7.3 make available or upload files that contain software or any other material not owned or licensed to the Subscriber and/or User; and
9.7.4 make use of the Website to collect, disseminate or otherwise obtain personal information relating to other Users or Subscribers
9.8 FTB expressly reserves it rights in respect of any abuse of the free or paid-for subscription services offered through this Website and will pursue prosecution of and compensation from any party which receives or attempts to receive any service to which he, she or it is not entitled.
9.9 The granting of a subscription, whether free or paid-for, is entirely within the discretion of FTB and may, without limiting such discretion, be refused where FTB reasonably suspects abuse of this Website or where the provisions of these Terms and Conditions of Use are breached.
9.10 No refunds will be offered should the User’s account be suspended or terminated owing to foul play, fraudulent activity, violation of FTB’s intellectual property rights, any breach in these Terms & Conditions or if the Subscriber uses our Website for any other purpose which does not align with what FTB deems to be the intended usage of our Service.

10. Receipt of data messages

10.1 Data Messages, sent by Users and FTB to each other shall be deemed to be received only when acknowledged or responded to.
10.2 A Data Message shall be regarded as received when the complete data message enters an information system designated or used for that purpose by the addressee and is capable of being retrieved and processed by the addressee.
10.3 FTB reserves the right not to respond to any Data Message which contains obscene, threatening, defamatory or otherwise illegal, unlawful or inappropriate content, and to take the appropriate action against the sender of such Data Message where necessary.
10.4 Users should be aware that filtering technology employed by internet service providers, employers and others may result in the non-delivery of a service subscribed to. FTB takes reasonable efforts to ensure that subscription services are not stopped by filtering technology used by FTB and will make reasonable attempts to remedy non-delivery where it is notified thereof. If you have not received a subscription service please notify us.

11. Monitoring and interception of communications

In order to provide a relevant and secure service, and where required to do so under law, FTB may monitor and/or intercept communications (including Data Messages) which are sent to this Website. To the full extent necessary under law the User hereby acknowledges that he or she is aware of such potential monitoring and/or interception and consents thereto in terms of sections 5 and 6 of the Regulation of Interception of Communications and Provision of Communication-Related Information Act 70 of 2002.

12. Submission and uploading of content

12.1 This Website offers a service through which Users may submit links to their websites, employment opportunities and events. Further functionality in this regard may be added from time to time.
12.2 FTB reserves the right, in its sole and absolute discretion, to approve or refuse any submission and submissions will only be posted online once approved.
12.3 FTB further reserves the right, in its sole and absolute discretion, to remove any submissions on such grounds as it may deem fit.
12.4 Any content received by Data Message will be assumed to have been submitted for publication free of charge, unless the sender clearly stipulates that payment for the content is required and includes all relevant contact and pricing information in the Data Message.
12.5 Any unsolicited information or material sent to FTB will be deemed not to be confidential, unless otherwise agreed to in writing by FTB.

13. Removal of content – notice of objection

13.1 If FTB receives a valid notice of objection relating to any content that is posted on this Website then FTB, subject to the provisions of this clause, will remove the content as contained on the Website.
13.2 A valid notice of objection must be emailed or posted to FTB and include:
13.2.1 full names and address of the complainant;
13.2.2 written or electronic signature of the complainant;
13.2.3 identification of the right that has allegedly been infringed;
13.2.4 identification of the material or activity that allegedly infringes this right;
13.2.5 the remedial action requested;
13.2.6 the telephonic and electronic contact details of the complainant;
13.2.7 a statement that the complainant is acting in good faith; and
13.2.8 a statement that the information is true and correct.
13.3 If FTB receives a notice of objection that complies with the above requirements and FTB is of the view that the objection is legally valid, FTB will remove the content and inform the complainant and, if necessary, the third party that posted that material immediately.
13.4 FTB expressly disclaims any liability which may arise as a result of the removal of content pursuant to the receipt of a valid notice of objection.

16.3 The Website owner reserves the right to request independent verification of any information transmitted via e-mail and the User consents to such verification should FTB deem it necessary.

21. What law governs these terms and conditions?

21.1 Subject to the dispute resolution provisions below, the User hereby agrees that the law applicable to these terms and conditions of use, their interpretation and any matter or litigation in connection therewith or arising from them will be the law of the United Kingdom.
21.2 This Website is owned, hosted and maintained within the United Kingdom.
21.3 When using this Website and agreeing to these Terms and Conditions such use and agreement is deemed to have taken place in the United Kingdom.

22. Dispute resolution

22.1 By accessing this Website you acknowledge and agree that in the event of any dispute or purported dispute arising out of use or inability to use this Website, or claim in respect of any service or product offered through the Website, or on any matter provided for in, or arising out of these terms and conditions, then that dispute shall be submitted to The Arbitration Forum and decided by mediation or arbitration, in accordance with The Arbitration Forum’s Mediation and Arbitration rules.
